Terms and Conditions

This Customer Account Agreement ("Agreement") is entered into by and between JMI Brokers LTD ("JMI") and the Customer. JMI Brokers LTD is a licensed broker from the Vanuatu Financial Services Commission as Dealers in Securities under license number 15010.

1. Risk Disclosure

Before engaging in products offered by JMI Brokers LTD, you should be aware of the risks involved in trading financial contracts for differences (CFDs). You should not enter into a transaction unless you fully understand the nature and fundamentals of the transaction and the market underlying it.

• The high degree of leverage obtainable in trading can work against you as well as for you due to fluctuating market conditions.
• If the market moves against you, you may sustain a total loss of your initial margin deposit and any additional funds deposited with JMI Brokers LTD.
• You may be called upon to "top-up" your margin at short notice to maintain your position, failing which JMI may liquidate your position at a loss.
• Under certain market conditions, you may find it difficult or impossible to liquidate a position, assess a fair price, or assess risk exposure.

2. Trading Authorization

JMI is authorized by the Vanuatu Financial Services Commission (VFSC) as "Dealers in Securities" to carry on the business of dealing in securities such as CFDs in commodities, equities, indices, and currency pairs. All CFD contracts are leveraged products and will be executed between you as principal and JMI as principal. You shall be directly and personally responsible for performing your obligations under every transaction.

3. Charges Payable by Customer

Customer agrees to pay commissions and service fees as JMI may establish from time to time. Customer is also liable for the amount of any loss resulting from transactions, including any deficit balance, and interest on any deficit balance at a rate of 3% over the Prime rate.

4. Force Majeure Events

JMI may determine that an emergency or exceptional market condition exists, known as a "Force Majeure Event". This includes acts such as strikes, power supply interruptions, or electronic communication equipment failure. In such events, JMI may increase deposit requirements, close open CFDs, or suspend the application of terms of this agreement.

5. Governing Law

This agreement shall be governed by the laws of the Republic of Vanuatu. Any action arising out of transactions under this agreement may not be brought by the customer more than three months after the cause of action arose.
